A good outcome for a Court of Protection client

Solicitor, Susannah Millard explains that the Court of Protection team had a brilliant outcome last week. The team had a complex matter, involving a young gentleman who was struck by a car and left with significant injuries, including a traumatic brain injury.
Our client was moved from a residential placement to a rehabilitation placement at which time he was assessed as lacking capacity and was deprived of his liberty.
Our client wished to challenge the Deprivation of Liberty on the basis he believed he had capacity. An independent expert was instructed and deemed the client to have capacity, however this was contested by other parties who wished to rely on alternative reports from professionals who were not instructed in the Court of Protection proceedings.
The matter was listed for a 2-day final hearing and oral evidence was heard from the experts. The Judge was satisfied that our client had demonstrated capacity.
Our client was thrilled with the outcome.
