Nuptial Agreements
OVERVIEW
Nuptial agreements include both prenuptial and postnuptial agreements.
They set out how finances, property, and assets should be dealt with if a relationship breaks down.
They’re not about expecting the worst, it’s about being clear from the start and avoiding uncertainty later on.

What to expect
A prenuptial agreement is entered into before marriage or a civil partnership.
A postnuptial agreement is made during the relationship or after marriage / civil partnership.
These agreements can cover:
- Property and assets
- Savings and investments
- Business interests
- Financial responsibilities
- How assets should be divided if you separate
While not automatically binding in England and Wales, courts will usually take a properly prepared agreement into account.
Why it matters
A nuptial agreement can:
- Protect assets you bring into the relationship
- Safeguard business interests or trusts
- Provide clarity around financial arrangements
- Help avoid disputes in the future
It can also be particularly useful where there are existing assets, children from a previous relationship, or differing financial positions.
