OVERVIEW

Understanding disputes

Disputes can arise for a number of reasons, including:

  • Concerns about the validity of a Will
  • Executors not carrying out their duties properly
  • Disagreements between beneficiaries
  • Claims that someone has been unfairly left out

Every situation is different, and the right approach will depend on the circumstances.

Who can make a claim?

Only certain people are entitled to bring a claim against an estate. This may include:

  • Spouses or civil partners
  • Cohabiting partners (usually living together for at least two years)
  • Children (including those treated as children by the deceased)
  • Anyone financially dependent on the deceased

Claims are often made under the Inheritance (Provision for Family and Dependants) Act 1975.
