OVERVIEW

Probate is the legal process of dealing with someone’s estate after they pass away.

This includes collecting assets, paying debts, and distributing what’s left to beneficiaries.

If you’re responsible for dealing with an estate, you may need to apply for a Grant of Probate or Letters of Administration. These give you the legal authority to act.

  • Grant of Probate – used where there is a valid Will
  • Letters of Administration – used where there is no Will

In some cases, where a Will exists but no executor is named, a different form of Letters of Administration may be required.

Full Detail

Do you always need probate?

Not always. Whether a grant is required depends on the type and value of assets, and the requirements of banks or other organisations.

How long does it take?

This depends on the estate. Straightforward cases may take a few months, while more complex estates can take longer—especially where there are disputes, tax issues, or multiple assets involved.
