Lasting Powers of Attorney are vital documents for people who are at risk of losing their mental capacity. They allow you to appoint people you trust (attorneys) to deal with your affairs on your behalf, whether this is in relation to your property and finance or health and welfare. A problem arises in that Lasting Powers of Attorney can only be put in place if a person has mental capacity. So, by the time someone needs to use the documents, if this is because of a lack of mental capacity, it would be too late to put them in place. This is why we at Cygnet Law recommend that these documents are considered by everyone, even if it is felt they are not relevant at the time.
